1. Acceptance of Terms
By accessing and using GetCollab ("the Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Description of Service
GetCollab is a marketplace platform that connects brands with creators for marketing campaigns and collaborations. Our services include:
- Campaign creation and management tools for brands
- Creator discovery and filtering capabilities
- Bidding system for creators
- Communication tools between brands and creators
- Payment processing and brand credit system
3. Third-Party Integrations (Meta/Instagram)
GetCollab integrates with Instagram and Facebook APIs to provide enhanced services. By using our platform, you acknowledge and agree to:
- Comply with Meta's Platform Policies, Terms of Service, and Community Guidelines
- Accept that Instagram/Facebook services are subject to their own terms and policies
- Understand that we are not responsible for changes, suspension, or termination of third-party services
We reserve the right to modify or discontinue integration features if required by Meta or for compliance purposes.
4. Intermediary Platform
GetCollab acts solely as an intermediary platform.
- We are NOT a party to any agreement between brands and creators
- We facilitate connections and provide tools for collaboration
- We do not guarantee the quality, timely delivery, or authenticity of work performed
- All negotiations, agreements, and transactions are between users directly
Users agree that any dispute arising from their collaboration is solely between them, and GetCollab bears no liability for outcomes.
5. User Accounts
5.1 Registration
- You must create an account to use our services
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old to create an account
5.2 Account Types
Users can register as either:
- Brand: To create campaigns and hire creators
- Creator: To bid on campaigns and offer services
6. User Responsibilities
6.1 Brand Responsibilities
- Provide clear and accurate campaign requirements
- Pay agreed amounts for completed work
- Respect intellectual property rights
- Provide timely feedback and communication
6.2 Creator Responsibilities
- Deliver work as specified in campaign requirements
- Provide authentic engagement metrics
- Comply with FTC disclosure guidelines and advertising regulations
- Maintain professional communication
7. Payments and Fees
7.1 Platform Access
- Brands can create accounts and launch campaigns without a monthly subscription fee
- Creators can create profiles and participate on the platform for free
7.2 Coin System
- 1 coin = ₹50
- Coins are used by brands for paid actions where applicable
- Creators can apply to campaigns without purchasing coins
- Coin purchases are processed through secure payment gateways
7.3 Platform Fees
GetCollab may charge service fees on transactions. These fees will be clearly disclosed before any transaction is completed.
7.4 Payment Risk
- Payments may be delayed or fail due to third-party processor issues
- GetCollab is not liable for payment delays or failures caused by external payment providers
- In case of payment failures, users must resolve issues with their payment provider before receiving funds
7.5 Refunds and Cancellations
Refunds and cancellations are governed by our Refund Policy. Please review that policy for detailed information on refund eligibility, timelines, and processes.
8. Prohibited Activities
Users are prohibited from:
- Engaging in fraudulent activities or misrepresentation
- Circumventing the platform to conduct transactions off-platform
- Harassment, discrimination, or abusive behavior
- Violating intellectual property rights
- Posting false or misleading information
- Using automated systems or bots
- Attempting to access unauthorized areas of the platform
8.1 Fraud and Misuse
We have zero tolerance for fraudulent activities. The following are strictly prohibited:
- Creating fake profiles or inflating follower counts
- Running misleading or scam campaigns
- Engaging in payment fraud or chargebacks
- Impersonating other users or brands
- Manipulating engagement metrics or reviews
Consequences: We reserve the right to immediately suspend or terminate accounts involved in fraud without prior notice. Users found in violation may be banned from the platform permanently.
9. User-Generated Content Liability
Users are fully responsible for all content they create, post, or share on the platform:
- You represent and warrant that you have all rights to content you post
- You are responsible for ensuring content complies with applicable laws
- GetCollab is not liable for any content posted by users
- We reserve the right to remove content that violates our policies without notice
10. Platform Availability
We strive to provide uninterrupted service, but we cannot guarantee it:
- No warranty that the platform will be available at all times
- Downtime may occur due to maintenance, updates, or technical issues
- We reserve the right to perform scheduled maintenance with reasonable notice
- We are not liable for any losses arising from service interruptions
- Users should not rely on the platform for time-critical operations
11. Content and Intellectual Property
11.1 User Content
Users retain ownership of content they create. By posting content on GetCollab, you grant us a non-exclusive license to display, distribute, and promote your content on the platform.
11.2 Platform Content
All platform features, design, and functionality are owned by GetCollab and protected by copyright and intellectual property laws.
12. Dispute Resolution
In case of disputes between brands and creators, we follow this escalation process:
- Step 1 - Direct Communication: Parties must first attempt to resolve the dispute through direct communication within 7 days
- Step 2 - Support Intervention: If unresolved, either party can submit a support ticket. We will review evidence within 5 business days
- Step 3 - Mediation: GetCollab may offer mediation services to facilitate resolution
- Step 4 - Final Decision: Final decisions will be made at GetCollab's sole discretion based on evidence provided
Liability Limits: GetCollab's liability in any dispute is limited to the platform fees paid for the specific transaction in question. We are not liable for indirect damages, lost profits, or consequential losses.
13. Termination
We reserve the right to suspend or terminate accounts that violate these Terms and Conditions. Users may also terminate their accounts at any time through account settings.
13.1 Termination Consequences
Upon account termination (voluntary or involuntary):
- Funds: Any unused balance in your account will be refunded according to our Refund Policy
- Ongoing Campaigns: Active campaigns will be halted; creators will be paid for completed work
- Data: Your data will be retained for 30 days for compliance purposes, then deleted
- Access: Immediate loss of access to platform features
14. Limitation of Liability
GetCollab is a marketplace platform. We are not responsible for the quality, accuracy, or legality of content posted by users, or for the conduct of users on or off the platform. We provide the platform "as is" without warranties of any kind.
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Users will be notified of significant changes via email or platform notifications. Continued use of the platform after changes constitutes acceptance of the updated terms.
16. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
